Introduction

JobDreamz, the website Owner, including subsidiaries and affiliates ("website" or "JobDreamz" or "we" or "us" or "our") provides the information contained on this website or any of the pages comprising the website ("website") to visitors ("visitors") (cumulatively referred to as "you" or "your" hereinafter) subject to the terms and conditions set out in these website terms and conditions, the privacy policy and any other relevant terms and conditions, policies and notices which may be applicable to a specific section or module of this website.

Advertising Guidelines

These terms and conditions apply to all advertising material accepted by JobDreamz for display on any of our websites. By placing an advertisement you accept these terms and conditions as principal, even if you are acting as agent or buyer for the actual advertiser. Once Published, adverts are immediately available to Candidates. However, all Published adverts are reviewed by JobDreamz to ensure they comply with JobDreamz advertising guidelines shown below.

All adverts must:

  • relate to only one job vacancy;
  • relate to only one location;
  • not discriminate by race, gender, age, disability, religion or belief, sexual orientation, or any other form of discrimination.

Adverts that do not comply with these guidelines will be placed Under Review and will not be available to Candidates during this period. Advertisers will then be given one chance to Edit the advert to comply with the guidelines and Republish at no extra cost. The date of publication will however remain as the originally published date and the duration of the advert will not be extended. If a Republished advert does not comply with the guidelines, it will be Cancelled without refund.

You are responsible for the content of the advertisement and for ensuring that it complies with all relevant legislation and codes of practice. If we receive complaints about the content of the advertisement we may, at our discretion, remove the advertisement from display without reference or liability to you. You will indemnify us against any claim that the advertisement or its content infringes the intellectual property rights or other rights of others or is defamatory or otherwise offensive. If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973) it is your responsibility to ensure the advertisements you place on JobDreamz comply with the Conduct of Employment Agencies and Employment Businesses Regulations 2003.

You are also responsible for dealing with any applications or enquiries relating to the jobs to which the advertisement relates and you will indemnify and hold JobDreamz harmless accordingly.

Your sole remedy if JobDreamz, or our third party subcontractors who may host and serve advertisements from time to time, make an error in displaying any advertisement is the cost of re-running the relevant advertisement. Neither we nor our subcontractors shall be liable in any circumstances for any loss of profit or business. We shall, additionally, have no liability for failure to display the advertisement caused by circumstances outside our control.

Public Forums and User Submissions

JobDreamz is not responsible for any material submitted to the public areas by you (which include bulletin boards, hosted pages, chat rooms, or any other public area found on the website. Any material (whether submitted by you or any other user) is not endorsed, reviewed or approved by JobDreamz. We reserve the right to remove any material submitted or posted by you in the public areas, without notice to you, if it becomes aware and determines, in its sole and absolute discretion that you are or there is the likelihood that you may, including but not limited to:

  • defame, abuse, harass, stalk, threaten or otherwise violate the rights of other users or any third parties;
  • publish, post, distribute or disseminate any defamatory, obscene, indecent or unlawful material or information;
  • post or upload files that contain viruses, corrupted files or any other similar software or programmes that may damage the operation of JobDreamz and/or a third party's computer system and/or network;
  • violate any copyright, trademark, other applicable Great Britain or international laws or intellectual property rights of JobDreamz or any other third party;
  • submit contents containing marketing or promotional material which is intended to solicit business.

You hereby indemnify JobDreamz against any loss, liability, damage or expense of whatever nature which JobDreamz or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website to send or post any such material.

Information on the Website

Whilst every effort is made to update the information contained on this website, neither JobDreamz nor any third party or data or content provider make any representations or warranties, whether express, implied in law or residual, as to the sequence, accuracy, completeness or reliability of information, opinions, research information, data and/or content contained on the website (including but not limited to any information which may be provided by any third party or data or content providers) ("information") and shall not be bound in any manner by any information contained on the website. JobDreamz reserves the right at any time to change or discontinue without notice, any aspect or feature of this website. No information shall be construed as advice and information is offered for information purposes only and is not intended for trading purposes. You and your company rely on the information contained on this website at your own risk. If you find an error or omission at this site, please let us know.

Interruptions & Omissions in Service - Force Majeure

Whilst JobDreamz constantly tries to ensure that the standard of this website remains very high and to maintain the continuity of it, the internet is not an inherently stable medium and errors, omissions, interruptions of service and delays may occur at any time. We do not accept any liability arising from such errors, omissions, interruptions or delays or any ongoing obligation or responsibility to operate this website (or any particular part of it) or to provide the service offered on this website. We may at any time vary the specification of this website without notice.

Warranties

JobDreamz makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the website, the information contained on the website, you or your company's personal information or material and information transmitted over our system.

Disclaimer of Liability

JobDreamz shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, you or your company's personal information or material and information transmitted over our system. In particular, neither JobDreamz nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.

JobDreamz does not make any warranty or representation that information on the website is appropriate for use in any jurisdiction (other than Great Britain). By accessing the website, you warrant and represent to JobDreamz that you are legally entitled to do so and to make use of information made available via the website.

Use of the Website - Terms of use

You may only use this website for lawful purposes when recruiting. You must not under any circumstances seek to undermine the security of the site or any information submitted to or available through it. In particular, but without limitation, you must not seek to access, alter or delete any information to which you do not have authorised access, seek to overload the JobDreamz system via spamming or flooding, take any action or use any device, routine or software to crash, delay, damage or otherwise interfere with the operation of this site or attempt to decipher, disassemble or modify any of the software, coding or information comprised in the site.

You are solely responsible for any information submitted by you to this site. You are responsible for ensuring that all information supplied by you is true, accurate, up to date and not misleading or likely to mislead or deceive and that it is not discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trade mark or other intellectual property rights of any person in any jurisdiction. You are also responsible for ensuring that all information, data and files are free from viruses or other routines or engines that may damage or interfere with any system or data prior to being submitted to this site. JobDreamz reserves the right to remove any information supplied by you from this website at our sole discretion, at any time and for any reason without being required to give any explanation.

Content Rights - Resale or Unauthorised Commercial Use

The rights in material on this site are protected by international copyright, software and trademark laws and you agree to use this site in a way which does not infringe these rights. You may copy material on this site for your own private or domestic purposes, but no copying for any commercial or business use is permitted. Further you agree not to resell or assign your rights or obligations under these Term and Conditions.

Termination of Service - Policy Regarding

JobDreamz may terminate your registration and/or deny you access to the site or any part of it (including any services or information available on or through this site) at any time in our absolute discretion and without any explanation or notification if we feel that you are using this site in an improper or unlawful way.

We may terminate the provision of Services if:

  • the Customer is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:
  • the Customer becomes insolvent, ceases to trade or goes into liquidation.

These Conditions apply unless replaced by subsequent Conditions.

The Customer shall be responsible for all reasonable costs, claims, damages, loss, expenses and liabilities incurred by JobDreamz arising out of the Customer's breach of its obligations under these Conditions (including, without limitation, on a solicitor and own client basis, any legal fees and disbursements reasonably incurred by JobDreamz).

Illegal Advertisements

Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. If we believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from JobDreamz website without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform you accordingly. You will normally be notified and given one chance to amend the advertisement.

Indemnity

The Client agrees to indemnify JobDreamz and to keep JobDreamz indemnified in respect of, but not limited to, all damages, costs or liabilities that JobDreamz may incur arising from an Advertisement or use of any Service, and in particular resulting from the following:

  • the publication of any defamatory statement;
  • breach of copyright;
  • any claims made by any person in respect of race, religion, age, sex or disability discrimination;
  • any breach by the Client of any warranty given hereunder.

Dealings with Candidates

JobDreamz requires you to agree to deal fairly and professionally with individuals you may contact using information from the candidate database and not do anything which may bring JobDreamz into disrepute. You will indemnify JobDreamz from and against any claim brought by an individual against JobDreamz arising from your breach of this obligation or any other of these terms and conditions.

Equipment

It is your own responsibility to ensure that you have the appropriate equipment and are connected to the appropriate services to enable you to post adverts to the JobDreamz website.

Employment Agencies & Employment Business Regulations 2003

Candidates and Advertisers need to be aware that the JobDreamz website operates as a venue only and does not introduce or supply candidates to advertisers (or vice versa). This means that JobDreamz does not:

  • obtain confirmation of the identity of candidates or that they have the experience, training, qualifications or authorisation to work in the position to be filled or that they wish to undertake the role to be filled;
  • take any steps to ensure the candidates and advertisers are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the work-seeker to fulfil the position to be filled;
  • take any steps to ensure that it would not be detrimental to the interests of the candidates or the advertisers for the candidates to fulfil the position to be fulfilled;
  • give any indication to advertisers whether candidates are unsuitable (or suitable) for any position to be filled in any circumstances;
  • propose candidates to advertisers or provide any information about them;
  • take up any references in relation to a candidates;
  • make any arrangements for accommodation of candidates.

The Conduct of Employment Agencies and Employment Business Regulations 2003 (the "Regulations") seek to ensure that candidates are only proposed by employment agencies for roles for which they are properly qualified and that advertisers are only offered candidates who have the appropriate levels of experience, training, qualifications and authorisation for the position to be filled.

Since we are only a venue and do not propose or introduce candidates to advertisers or vice versa, it is recommended that, if you are a candidate you undertake the steps set out in the Regulations to ensure your suitability for the role advertised or, if you are an advertiser, to ensure a candidate is suitable for the role.

These could include:

  • If you are a candidate; checking the identity of the advertiser and the nature of its business, the commencement date and duration of the position, the position to be filled including type of work, location, hours and risks to health and safety, experience, training, qualifications and authorisation which the advertiser considers necessary or are required by law or otherwise to undertake the position, whether any expenses are payable by you as a candidate or whether there are any requirements imposed by law or otherwise for you to satisfy before taking up a position.
  • If you are a advertiser; checking the identity of the candidate and that the candidate has the experience, training, qualifications and authorisation required by law or otherwise for the position and whether there are any requirements imposed by law or otherwise for you, as the advertiser, to meet to enable a candidate to take up a position.
  • In addition, where professional qualifications are required or where candidates are to work with vulnerable persons or children, you should obtain copies of the relevant qualifications or authorisation, obtain at least two references from people who are not relatives of the candidate and undertake a criminal records bureau check of the candidate.

General

Entire Agreement

These website terms and conditions constitute the sole record of the agreement between you and JobDreamz in relation to your use of the website. Neither you nor JobDreamz shall be bound by any express, tacit or implied representation, warranty, promise or the like not recorded herein. Unless otherwise specifically stated these website terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and JobDreamz in respect of your use of the website.

Alteration

JobDreamz may at any time modify any relevant terms and conditions, policies or notices. You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the "current version") and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website.

Conflict

Where any conflict or contradiction appears between the provisions of these website terms and conditions and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices which relate specifically to a particular section or module of the website shall prevail in respect of your use of the relevant section or module of the website.

Waiver

No indulgence or extension of time which either you or JobDreamz may grant to the other will constitute a waiver of or, whether by estoppels or otherwise, limit any of the existing or future rights of the grantor in terms hereof, save in the event or to the extent that the grantor has signed a written document expressly waiving or limiting such rights.

Cession

JobDreamz shall be entitled to cede, assign and delegate all or any of its rights and obligations in terms of any relevant terms and conditions, policies and notices to any third party.

Severability

All provisions of any relevant terms and conditions, policies and notices are, notwithstanding the manner in which they have been grouped together or linked grammatically, severable from each other. Any provision of any relevant terms and conditions, policies and notices, which is or becomes unenforceable in any jurisdiction, whether due to voidness, invalidity, illegality, unlawfulness or for any reason whatever, shall, in such jurisdiction only and only to the extent that it is so unenforceable, be treated as pro non scripto and the remaining provisions of any relevant terms and conditions, policies and notices shall remain in full force and effect.

Applicable Laws

Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of Great Britain without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the High Court of Great Britain in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.
